Quick Summary
Illinois proposes a 0.2% tax on covered crypto activity.
Stablecoins are included, while NFTs are excluded.
Illinois tax officials have released draft rules explaining how the state's new digital asset transaction tax would apply to stablecoins, decentralized finance platforms, crypto bridges and certain transfers to self-custody wallets. The rules provide additional detail on a tax that was already enacted earlier this year and is scheduled to take effect on January 1, 2027.
Under Illinois' Digital Asset Tax Act, a 0.2% tax applies to the value of digital assets involved in covered digital asset business activity received by customers in the state. The underlying law defines this activity to include exchanging, transferring and storing digital assets when those services are provided by a digital asset broker. The tax is separate from existing occupation or privilege taxes.
The newly published draft rules clarify that stablecoins would fall within the tax's scope, while nonfungible tokens would be excluded. This distinction provides more detail for businesses handling different categories of digital assets and indicates that the tax framework is focused on specified digital asset business activity rather than every possible blockchain transaction.
The treatment of DeFi transactions is more specific. The draft generally exempts DeFi activity unless a user pays a fee that qualifies as "valuable consideration." Protocol fees collected for operating or maintaining a platform could therefore fall within the tax, while network fees and swap fees paid solely to liquidity providers would not trigger the tax under the proposed rules.
The rules also address crypto bridging. When bridging is conducted through a digital asset broker in exchange for consideration, the activity can be treated as a taxable exchange. Similarly, transfers from centralized exchanges to self-custody wallets could become taxable when the exchange charges a fee for the transfer. This makes the treatment of movements between custodial and self-custody environments an important consideration for affected users and businesses.
Illinois' tax legislation has already faced opposition from cryptocurrency industry groups. The Crypto Council for Innovation and Blockchain Association have sought to prevent the tax from taking effect, arguing in court that the measure violates constitutional and other legal requirements and could create significant compliance costs for digital asset companies. Those arguments are contested legal claims rather than established findings.
The Illinois Department of Revenue said the current rules are still in the draft stage. The department is accepting public comments through October 30, 2026, and the proposed rules have not yet been filed with the Illinois Secretary of State or submitted to the Joint Committee on Administrative Rules. Changes could therefore occur before the final framework is implemented.
The tax represents a different approach from conventional cryptocurrency taxation based primarily on gains or income. Illinois is applying a transaction-based tax to covered digital asset business activity, meaning the tax can be connected to the value of the underlying asset involved in the activity, rather than simply the user's profit. PwC described the measure as a tax on digital asset business activity involving exchanges, transfers and storage.
For crypto businesses, the practical implications could extend beyond the tax itself. Brokers and other covered service providers may need systems capable of identifying taxable transactions, calculating the applicable amount and collecting the tax from customers. The final interpretation of DeFi fees, bridges and transfers will therefore be important for companies operating in or serving customers in Illinois.
