Quick Summary

Indiana’s HB 1042 expands legal protections for cryptocurrency use.

Certain retirement plans would be required to offer crypto investment choices.

Indiana’s state legislature has overwhelmingly passed House Bill 1042, a wide-ranging crypto rights bill that now heads to Governor Mike Braun for final approval. The measure, approved by both the House and Senate, is designed to expand legal protections for cryptocurrency users, ban discriminatory taxation on digital assets, and open the door for certain state-administered retirement plans to offer crypto investment options.

At its core, HB 1042 seeks to provide clearer legal status for Bitcoin and other digital assets within Indiana’s legal framework. If signed into law, the bill would prohibit most state and local agencies with the exception of the Department of Financial Institutions from adopting regulations that restrict an individual’s ability to use crypto as payment, hold assets in self-custody wallets, or engage in lawful mining and node operations. Proponents describe this legal baseline as a state-level affirmation of crypto rights that protects residents from targeted regulatory actions.

A significant provision of the bill focuses on public retirement and savings plans. HB 1042 would require several defined contribution plans including state employee, teachers’ retirement funds, and programs like the Hoosier START college savings plan to offer self-directed brokerage accounts that include at least one cryptocurrency investment option, such as a regulated crypto ETF. Lawmakers emphasised that this requirement does not compel retirement administrators to invest directly in cryptocurrencies but enables participant choice where appropriate.

The measure also would ban discriminatory taxes or fees specifically targeting crypto transactions beyond the scope of general financial activity, aiming to ensure that digital assets are treated equitably compared with other investment and payment methods. Supporters argue that such protections are essential as digital assets become increasingly integrated into financial systems and as states compete to attract blockchain businesses and innovation. Critics of similar state bills often point to concerns about volatility and fiduciary risk, particularly when contemplating exposure within long-term retirement portfolios.

HB 1042 reflects a broader trend among U.S. states seeking to establish pro-innovation regulatory environments for digital assets, with other states like Oklahoma, Kentucky, and Pennsylvania taking parallel steps to codify crypto rights at the state level. If Governor Braun signs the bill as expected, most provisions would take effect on July 1, 2026, while the additional requirements related to retirement plan options would take effect later, pending regulatory guidance or administrative action.

For investors and market observers, the advancement of HB 1042 highlights growing legislative efforts at the sub-federal level to integrate digital assets into mainstream financial frameworks while preserving property rights and market accessibility. Sentiment around this development is positive, reflecting confidence that clearer legal protections could foster broader adoption and investment opportunities within regulated channels.
