Quick Summary

US Senate returns from recess to resume CLARITY Act debate

Bill faces pushback over ethics provisions and stablecoin rules

The United States Senate has returned from its Memorial Day recess and is expected to resume debate on the Digital Asset Market Clarity Act, commonly known as the CLARITY Act, a sweeping crypto market structure bill that has become one of the most closely watched pieces of financial legislation in years.

The bill passed the House of Representatives in July 2025 and has since cleared two Senate committees, the agriculture committee in January and the banking committee in May. Lawmakers are now expected to begin consolidating the two versions of the bill ahead of a potential floor vote.

Coinbase chief policy officer Faryar Shirzad described the legislation as "the biggest financial regulatory bill that Congress has done in quite some time, certainly since Dodd-Frank," referring to the landmark 2010 law enacted in response to the 2008 financial crisis.

The CLARITY Act is designed to give the federal commodities regulator greater authority over digital assets, providing a clearer regulatory framework for the crypto industry. However, the bill has faced significant pushback from both industry representatives and banking groups over several contentious provisions.

JPMorgan CEO Jamie Dimon stated that the banking industry would not accept the bill as written, arguing that it allows crypto companies to pay interest on user deposits and stablecoin balances. Meanwhile, Senator Kirsten Gillibrand warned that "there will be no one voting for this bill if we don't have an ethics provision," citing concerns over conflicts of interest.

Several lawmakers, including Senator Elizabeth Warren, have raised concerns about President Donald Trump's ties to the crypto industry, pointing to his memecoin, his family's crypto business World Liberty Financial, and other potential conflicts of interest as an elected official.

White House crypto adviser Patrick Witt had previously set a target of the US Independence Day holiday for the bill's passage, though it remains unclear whether the legislation will be ready for a vote amid ongoing disagreements. The Republican-led Senate would still need some Democratic support to meet the 60-vote threshold required to pass the bill.

Prediction market Polymarket currently shows a 55% probability of the CLARITY Act being signed into law this year, with more than $1.1 million wagered on the outcome.

Separately, the US Treasury Department, the FDIC, FinCEN, and the Treasury's Office of Foreign Assets Control are set to close their public comment period on the GENIUS Act, a stablecoin payments bill signed into law in July 2025. At least one banking group has requested an extension of the comment period, though the deadline is expected to mark the next step in the bill's implementation.

The renewed Senate activity comes at a pivotal moment for the US crypto industry, which has long sought a clear regulatory framework to govern digital asset markets. With both the CLARITY Act and the GENIUS Act advancing through the legislative process, the coming weeks are expected to be critical in shaping the future of crypto regulation in the United States.
